Daniel Chapter One (DC1) Fights Back Only Nutritional Supplement Group Standing Up to Federal Trade Commission (FTC) Tyranny Only Group Raising Constitutional Issues About Right to Make Truthful Statements Only Group Defending Consumer Rights to Receive Health Information. Standing Up to the FTC: In mid 2008 an FTC internet witch hunt netted 130 companies and one non profit religious group, Daniel Chapter One that used the words “cancer” and “dietary supplement,” whether truthfully or not, on the same web site. The FTC charged and ordered all of them to cease their “fraudulent”—even though truthful--use of the words and to write to all their constituents that only drugs and radiation are proven to be useful for cancer. No information about cancer—even if true--or testimonies of people whose cancer disappeared after using herbs could be displayed. Daniel Chapter One through its lawyers say this violates the Untied States Constitution’s First Amendment rights of freedom of speech, freedom of the press, and freedom of religion.In Sept 2008, the FTC officially charged the tiny religious ministry with making statements that Daniel Chapter One never actually made! In a deceptive move, the FTC listed in their Charge statements of supposed health claims they purported Daniel Chapter One to have implied from its structure/function information, with no evidence (and no consumer complaint in 23 years) that any DC1 information is false or misleading. Daniel Chapter One Overseer Mr. James Feijo and Daniel Chapter One believe strongly that neither he nor his ministry has done anything that they are not entitled to do. He tried, and believes he succeeded, to comply with any and all just and constitutional laws that govern his conduct. Right to Make Truthful Statements: The FTC threatened to place a pecuniary and odious Order on DC1, which Mr. Feijo could not agree to. The Order included demands for the Daniel Chapter One customer list with customers’ personal information, demands that Feijo “waive” his rights and that he agree to FTC spying, “posing as customers and clients , (or) employees. . . without the necessity of identification or prior notice.” The Order, not to terminate for 20 years, included many other specific demands which violate Mr. Feijo’s basic philosophy. Including The most egregious part of the Order for Feijo, was a letter written by the FTC , which the Commission proposed and ordered to be printed on DC1 letter head, be signed by Mr. Feijo and mailed to all Daniel Chapter One followers. The letter said that there is no scientific substantiation that any Daniel Chapter One product or ingredients may help in illness. It ordered Daniel Chapter One to say “(only) conventional cancer treatments have been scientifically proven to be safe and effective in humans.” The FTC letter took it one backbreaking step further. Daniel Chapter One must, in all its future advertising direct people to- the National Cancer Institute. Again this violated Mr. Feijo's beliefs. Consumer Rights to Receive Health Information: The Feijos, Jim and his wife Tricia, secretary of DC1, resolved to fight for the consumer right to know the truth about cancer and herbs. They hired a good attorney, and came to support a legal team of five as the case grew. They have been speaking out on radio, and presenting their Health Freedom Fight to groups of concerned citizens across the country. A few politicians have voiced support of Daniel Chapter One’s Health Freedom Fight. Daniel Chapter One awaits the verdict from the first hearing held in the FTC building, Washington, DC., April 21 – 27. The FTC managed to block the testimony of nearly all non expert witnesses who came to defend Daniel Chapter One. Expert Witnesses for Daniel Chapter One testified that there is ample scientific substantiation for all statements actually made. Daniel Chapter One can show it has helped many people over the past 23 years, with hundreds of radio sound bites and testimonials from people who say their health and life have been improved –even saved – with Daniel Chapter One products and information. Daniel Chapter One was not only part of an unreasonable federal witch hunt, but has become part of a national debate over the right of the individual to information and choice when it comes to health care.
